Lake County, FLA. — One of three suspects in the shooting death of an 87-year-old man at a gas station has pleaded no contest and was sentenced to 45 years in prison.
Kenneth D. Bailey, 22 entered the plea to second-degree Murder last week for the 2024 attack of Clarence Harold Ervin who was sitting in his car at the pump when three men approached his car. One of the men walked up to the driver’s side, talked to Ervin, then shot him in the. hand and abdomen.
He was taken to Orlando Regional Medical Center where he later died.
Judge Cary Rada sentenced Bailey to 540 months in prison. There is a minimum-mandatory sentence of 25 years.
“Despite his young age, this defendant made the choice that led to the tragic and senseless loss of an innocent life. This conviction and substantial sentence underscore the seriousness of his actions and provide justice for the victim’s family and friends,” said Walter Forgie, Chief Assistant State Attorney.
One other suspect has been arrested. A third is being investigated.
The shooting was captured on cell phone video by a witness, and several other cameras depicted their movements walking toward the Citgo at 210 W. Main St.
